This Privacy Policy explains how Elrod Technologies Group, LLC ("ETG," "we," "us," or "our") collects, uses, shares, and protects personal information in connection with WAXBOARD and its websites, applications, accounts, subscriptions, support, and AI-assisted features (the "Service").
If you use the Service under an agreement between your organization and ETG that includes our Data Processing Addendum, your organization controls the content in its workspaces, and that agreement governs how we process it.
1. Information We Collect
Information you give us
- Account information: name, email address, authentication credentials or identifiers, organization name, role, and account preferences.
- Billing information: plan, credit purchases, invoices, billing address, and payment status. Card details are collected and stored by our payment processor, Stripe. ETG does not store full card numbers.
- Your content: workspaces, uploaded files and drawings, prompts, generated outputs, notes, and settings.
- Support and communications: messages, feedback, and troubleshooting details you send us.
Information collected automatically
- Usage and device information: features used, log data, browser and device type, IP address, approximate location derived from IP address, pages viewed, timestamps, errors, and diagnostics.

2. How We Use Information
We use personal information to:
- provide, operate, maintain, secure, and troubleshoot the Service;
- create and manage accounts, subscriptions, credits, invoices, and support requests;
- process your content and generate the outputs you request, including AI-assisted outputs;
- monitor reliability, fix problems, and improve the Service;
- prevent fraud and abuse, enforce our policies, and comply with law; and
- send account, billing, security, and service communications, and, where permitted, product news. You can opt out of marketing email at any time using the unsubscribe link.
3. AI Processing
When you use an AI-assisted feature, the content needed for that request is processed by our AI infrastructure and AI service providers, OpenAI and Amazon Web Services, solely to produce the output you asked for.
We do not use your content to train AI models, and we do not allow our AI providers to train on it, unless you expressly opt in or agree otherwise in writing. See the AI Usage and Disclosure Policy.
4. How We Share Information
We do not sell personal information, and we do not share it for cross-context behavioral advertising. We share it only:
- With service providers who process it on our behalf for hosting, storage, authentication, payment processing, communications, support, security, and AI processing, under contracts that limit their use of it. A current list of these subprocessors is available at elrodtg.com/legal/subprocessors.
- At your direction, for example when you invite collaborators, share a workspace, connect an integration, or export content.
- For legal and safety reasons, when required by law or legal process, or when needed to protect the rights, safety, and security of our users, ETG, or others.
- In a business transfer, such as a merger, acquisition, financing, or sale of assets, subject to this Policy.
5. Data Retention
We keep personal information only as long as needed for the purposes in this Policy, including to provide the Service, meet legal and accounting obligations, resolve disputes, and enforce our agreements. Specific periods are set out in the Data Retention Policy.
6. Cookies and Similar Technologies
We use cookies and browser storage that are strictly necessary for sign-in, security, and remembering your preferences. We use analytics only if you allow them through the cookie preferences control. We honor Global Privacy Control signals as an opt-out where required by law. See our Cookie Policy for details.
7. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information, including encryption in transit. No system is completely secure, so we cannot guarantee absolute security. You are responsible for keeping your credentials safe.
8. Your Rights and Choices
Depending on where you live, you may have the right to:
- access the personal information we hold about you and receive a portable copy;
- correct inaccurate information;
- delete your information;
- object to or restrict certain processing; and
- withdraw consent where processing is based on consent.
To make a request, email legal@elrodtg.com. We will verify your identity before acting on a request, will respond within the time required by applicable law, and will not discriminate against you for exercising your rights. You may use an authorized agent where the law allows. If we deny your request, you may appeal by replying to our decision.
You can also update account information in your account settings and unsubscribe from marketing email at any time.
9. Children
The Service is not directed to children and is intended for users who are 18 or older. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.
10. International Users
ETG is based in the United States, and we and our service providers process information in the United States and other countries. Where required, we use appropriate safeguards, such as standard contractual clauses, for international transfers.
11. Changes to This Policy
We may update this Policy from time to time. We will post the updated Policy with a new "Last updated" date and, if changes are material, notify you through the Service or by email before they take effect.
